NEET SS: Supreme Court reserves interim order on plea against 50% quota in SS courses in Tamil Nadu

NEW DELHI: The Supreme Court has reserved the interim order on a plea challenging 50% reservation to in-service doctors in National Eligibility cum Entrance Test super-speciality courses (NEET SS) courses in government medical colleges in Tamil Nadu, as per a Live Law report.

A bench comprising Justices L Nageswara Rao and B R Gavai has reserved the interim order after hearing the submissions of counsels for parties.

Senior advocate Dushyant Dave had submitted that the government order was “completely unconstitutional” and “without any authority”. He referred to the clause which says that there is no reservation of seats for super-speciality courses.

When asked about the date of issuance of the impugned order, Dave replied that it was issued on November 7, 2020. Referring to an old order providing special provisions for admissions of in-service doctors in medical courses, he submitted that the government order “singularly relies on the judgment of the Constitutional Bench without understanding. Because that judgment was with respect to post-graduate.”

Meanwhile, the Federation of Resident Doctors’ Association (FORDA) in a letter to Union Health Minister Mansukh Mandaviya urged to expedite the NEET SS Counselling 2021. Any further delay in the NEET SS Counselling 2021 and subsequent admission of candidates will impact the delivery of quality patient care services, FORDA said.
