Rajasthan HC cancels round one PG medical and dental admissions 2020

NEW DELHI: The Rajasthan High Court has cancelled all the PG medical/dental admission granted in the round one of Rajasthan NEET PG/MDS counselling 2020. The order was passed after the petition was filed mentioning that the authority had not included the 89 seats allotted for the implementation of Economically Weaker Section (EWS) Quota of the state. The single bench of Justice S P Sharma issued the order on a bunch of petitions filed by Kamlendra Singh and others.

Earlier, the Medical Counselling of India (MCI) had issued a letter to all the state medical colleges asking to include 89 seats in the Postgraduate for EWS category, However, the SMS Medical College authority had released the round one result on April 26, without including the EWS seats.

Fresh round of counselling with EWS quota
As per the Rajasthan HC judgment: "The State Government shall conduct a fresh round of counselling for admission to PG seats by including the additional seats allotted for implementation of EWS quota as per the MCI letter dated February 27, 2020."

The court further stated that although the admission given in the first round of Rajasthan PG medical counselling has been cancelled, if the student was allotted the same college, his/her admission be given accordingly. For students who have already deposited the fee for the particular seat and has not been able to get that seat, the fee will be refunded.

“The admissions given in the first round of counselling would be treated as cancelled. However, if in the second round of counselling, the students are allotted the same college, their admission shall be accordingly made. In other cases, where a student has not been able to get a particular seat, his fees already deposited, shall be returned. The exercise shall be immediately conducted on completion of the All India Counselling. “ said Rajasthan HC

10% EWS Quota Implementation
The court also stated that the state government shall be free to fill EWS 10% quota by applying plain roaster of 10%, which indicates that aspirants who do not belong to the scheme of reservation for any reserved category (SC/ST/OBC) shall get 10% reservation. The EWS reservation should be applied according to the roaster of only 89 seats which were made available by the MCI for implementation of EWS quota.

Rajasthan HC order said: "The State Government shall be free to fill EWS 10% quota by applying plain roster of 10%. The roster of direct recruitment shall not be applicable for the said purpose. The EWS reservation shall apply as per roster to the only seats which are made available by MCI for implementation of EWS quota vide letter dated February 27, 2020."

Rajasthan PG medical counselling 2020
The counselling committee conducts Rajasthan PG medical/dental for admission to around 977 MD and 469 MS seats offered by 19 medical colleges of the state under 50% state quota seats. While the remaining 50% seats from government medical colleges will be granted under All India Quota seats and will be offered by Medical Counselling Committee (MCC).
