Appeal against stay on 91 pc SC reservation in MBBS admissions: BSP to UP govt

Lucknow: Bahujan Samaj Party president Mayawati on Friday asked the Uttar Pradesh government to appeal in the Supreme Court against the high court's stay on implementing nearly 91 per cent reservation for SC students in MBBS admissions in four medical colleges in the state.

Mayawati said the court probably would not have imposed a stay if the state government strongly argued that the additional reservation was provided in medical colleges built with funds meant for the welfare of the SC category.

In an X post in Hindi, Mayawati said, "If the Uttar Pradesh government had strongly advocated in the honourable court that the provision for additional reservation for the Scheduled Castes category in the medical colleges built in Saharanpur, Ambedkarnagar, Kannauj and Jalaun districts with funds from the 'Special Component Plan' meant for the welfare and benefit of the SC community is separate from the general 50 per cent reservation, and that this arrangement proves the full utility of the Special Component Plan, then perhaps the honourable court would have certainly given positive consideration to this and not imposed a stay on it."

But now, she said, the High Court has imposed a ban on this and the medical admissions here are also affected by it. In such a situation, it would be appropriate for the Uttar Pradesh government to appeal in the Supreme Court immediately for the required relief.

Allahabad HC stays 91% MBBS quota

The Lucknow bench of Allahabad High Court on Wednesday stayed the implementation of nearly 91 per cent reservation for NEET-UG admissions to MBBS courses in four government medical colleges in Uttar Pradesh, while allowing counselling to proceed based on the reservation percentages applicable in other government medical colleges.

A bench of Justices Alok Mathur and Amitabh Kumar Rai permitted counselling with 21 per cent reservation for Scheduled Castes, 2 per cent for Scheduled Tribes and 27 per cent for Other Backward Classes. Admissions made pursuant to the counselling will, however, remain subject to the outcome of the proceedings.

The court also issued a show-cause notice to the Additional Chief Secretary, Medical Education Department, asking why criminal contempt proceedings should not be initiated against him for allegedly failing to comply with an undertaking given before the court last year.

State had promised reservation compliance

During the hearing, senior advocate A N Tripathi, appearing for the petitioners, submitted that the state government had given an undertaking during the previous proceedings that the reservation arrangement would be brought in line with the statutory provisions from the 2026-27 academic session.

Despite this, the reservation in the four colleges had resulted in the overall quota reaching nearly 91 per cent, he submitted. The petition challenged the reservation arrangement for state-quota seats in the four government medical colleges for the current NEET-UG admission session.

The petitioners contended that the arrangement was contrary to the statutory reservation framework and also breached the assurance given to the court during earlier proceedings. Taking note of the submissions, the bench stayed the 91 per cent reservation arrangement.

At the same time, it did not halt the counselling process altogether, allowing the authorities to proceed with admissions by applying the 21 per cent reservation for Scheduled Castes, 2 per cent for Scheduled Tribes and 27 per cent for Other Backward Classes.
