UP magistrate who ordered Gautam Buddha University student to sign Rs 5 lakh bond suspended, SC told

Just a day after the Supreme Court summoned the Uttar Pradesh district magistrate and asked it to explain the reason behind issuing a show-cause notice to a Gautam Buddha University student for joining the Jantar Mantar protest, the UP government has suspended the executive magistrate, who ordered the university student to sign Rs 5 lakh bond.

The Cockroach Janta Party (CJP) announced the development through its official X account and said: “CJP will do whatever it takes to ensure that no student is ever intimidated for exercising their rights.”

"VICTORY OF THE STUDENTS," the Students Federation of India (SFI) said on a social media post over the suspension of the executive magistrate, who issued notice to Akshath Tripathi over the Jantar Mantar protest.

"A WARNING TO THOSE WHO ABUSE POWER: WE WILL NOT BE SILENCED. Mr Modi & Yogi BEWARE-STUDENTS FIGHT BACK," SFI said in the post.

The apex court in an official statement said that a student exercising his right to protest should not be “intimated” through such “disproportionate action.”

Action against university student by Noida admin was unacceptable: CJP

“The UP administration must explain itself before the Supreme Court. This is exactly why constitutional rights and judicial oversight matter,” the court said.

The notice from the top court comes few days after the UP district authority ordered Akshath Tripathi, a 2nd-year law student of Gautam Buddha University, to sign a bond and pay Rs 5 lakh as surety to maintain peace.

The order from the UP administration accused Tripathi of spreading anti-government propaganda and inciting fellow students to join a proposed protest by the Cockroach Janta Party (CJP).

According to Ratna Singh, legal affairs head of CJP, on September 1, the Supreme Court, in its verdict, quashed all the cases registered against the National Eligibility-cum-Entrance Test (NEET) protesters from Jantar Mantar.

Despite the SC’s order, the action taken against the university student by the Noida administration was “completely unacceptable,” Singh said.

Notably, the Noida police’s order against Akshat was revoked the same day it was issued. However, no one informed the student about it and his family members were receiving calls from the police until yesterday and asked them to persuade Akshat against doing any protest, she added.

The Chief Justice of India Surya Kant, in the SC’s judgement, also stated that there will be no complaint registered against the students related to any protest and all the protesters were protected under the SC’s order.
