UP Teacher Recruitment Case: The court has set aside the selection lists issued in June 2020 and January 2022, which included 6,800 candidates from reserved category.
NEW DELHI: The Allahabad High Court has directed the Uttar Pradesh government to prepare a fresh selection list for the appointment of 69,000 assistant teachers in the state. The court has set aside the selection lists issued in June 2020 and January 2022, which included 6,800 candidates. The court has directed the state government to prepare a new merit list within three months, ensuring compliance with the Basic Education Rules and Reservation Guidelines.
The court instructed that in preparing the new selection list, measures should be taken to minimize any negative impact on the currently employed assistant teachers by permitting them to finish the ongoing academic session. This step is aimed at avoiding disruption to students' education.
Reserved candidates in general merit list to shift category
The bench revised its previous order, stating that reserved category candidates who qualify for the general category merit list should be moved to that category. Additionally, it mandated that vertical reservation benefits be extended to horizontal reservation categories . The court upheld the single-judge's ruling to nullify the January 5, 2022, selection list, which included 6,800 candidates from the reserved category.
The single-judge had ruled that candidates who received reservations in the Teacher Eligibility Test (TET) should not be considered under the unreserved category, even if they met the general category cut-off marks. However, the current bench has now clarified that these candidates should be moved to the general category if they qualify based on merit.
