During the hearing on Monday, Advocate Abhishek Choudhury, appearing for the intervenors, said that it has been said by the board that the exam will be held when the situation is 'conducive'. “Which means that if a compartment student does well in an entrance test like CLAT, he/she can't take admission because Class 12 exams for compartment students are in abeyance,” Live Law quoted Choudhury.
“This will affect not only their right to equality but also their right to equal opportunities to get admission in colleges for higher studies,” Advocate Choudhury further said, as per the report.
A vacation bench comprising AM Khanwilkar and Dinesh Maheswari heard the matter.
Around 1,152 students filed a joint petition, seeking direction to the CBSE for cancellation of the 12th board compartment, private, HSC, and NIOS examination in physical mode. Students are demanding to be evaluated on a similar assessment formula as adopted by CBSE for the regular students and to release CBSE result 2021 in a time-bound manner.
The Supreme Court is also expected to make a final decision on the evaluation scheme proposed by CBSE and ICSE.
