Moradabad commissioner's court stays demolition order against Jauhar University

The Moradabad Divisional Commissioner's court on Monday granted an interim relief to Jauhar University, postponing the hearing of the proposed demolition of 38 structures on the campus till final hearing in the matter. The university's counsel had filed an application before the court that led to the interim stay.

As per PTI report, the proceedings could not be held on hearing date Tuesday as a condolence meeting was to be held after the death of an advocate in Moradabad, said divisional commissioner Anjaneya Kumar Singh. He said this was an acceptance of their application to the university.

He told PTI, "The application moved by the university's counsel has been accepted and demolition of any structure has been stayed till further orders. The stay will remain in force until the final hearing in the matter."

Protest continues by students about order

According to a PTI report, the postponement of the demolition order is coming as the protest of the students against the proposed demolition moves into its 12th day.

As per PTI report, the demolition order was "arbitrary" and "undemocratic," claimed former Rajya Sabha member and the university's pro-vice-chancellor, Tazeen Fatma in a statement. If the decision goes against the Jauhar university, it will go to the high court and, if needed, the supreme court, she said.

Fatma stated that samajwadi party president Akhilesh Yadav will soon visit the protesting students and had on passed the message that the Samajwadi party wholeheartedly supports the Jauhar University.

Demolition order sparked political protests

According to a PTI report, the Rampur Development Authority (RDA) had asked the university administration to pull down 38 out of 40 buildings in the university in 15 days saying they were built without proper approval. It was given based on Section 27(1) of Uttar Pradesh Urban Planning and Development Act, 1973 for non-availability of approved building maps.

The deadline to comply with the demolition order is July 30. Students protested against the proposed action on the university campus outside the gate, and Samajwadi Party and other political parties and social organisations protested against it and asked for withdrawal of the order.
