NEET PG counselling 2021 and NEET UG counselling 2021 can now commence as per the existing reservation policy, including 27% for OBC and 10% for EWS, the apex court said. A bench of justices DY Chandrachud and AS Bopanna today said, “Validity of OBC reservation in NEET PG and UG has been upheld.” Justice DY Chandrachud says, "We accept the recommendation of the Pandey committee to apply the criteria from next year. Counselling shall be conducted by giving effect to the reservation.”
A bench of justices DY Chandrachud and AS Bopanna asked the parties to file their written submissions for consideration. "We have been hearing this matter for two days, we must start counselling in national interest," the bench said.
Senior Advocate Arvind Datar reiterated that the basis of the Centre's criteria for determining EWS for the purpose of reservation in the NEET AIQ - cut-off income of Rs 8 lakh and of property assets - is completely "arbitrary".
While Solicitor General Tushar Mehta requested the Court to allow commencement of NEET PG counselling. Senior Advocate Shyam Divan argued that introducing OBC, EWS quota in July after the issuance of exam notification amounted to changing the rule midway, as per Live Law. He also argued that PG admissions must be totally merit-based and reservations must be minimal.
Advocate Archana Pathak Dave for the Federation of Resident Doctors Association (FORDA), which has sought to intervene in the case, said, "NEET PG counselling has to start immediately because 3rd year residents are about to pass out in four months. We'll be left with 33% of the workforce. With 3rd wave coming we need doctors."
The Supreme Court was hearing a batch of pleas challenged the July 29 notice providing 27% reservation for Other Backward Classes (OBC) and 10% for Economically Weaker Sections (EWS) category in 15% UG and 50% PG All India Quota seats (MBBS or BDS and MD, MS, MDS) with effect from the academic session 2021-22.

After the Supreme Court judgement on EWS, OBC quota, the MCC is expected to release the counselling notification soon on mcc.nic.in. This year onwards, NEET UG and PG 2021 counselling will be conducted in four rounds. The counselling scheme for central institutions will remain the same as previous years. “The proposed modified scheme of Online 4 rounds of counselling will be in tune with the prevailing norms of counselling (including the fees and security deposit) being followed for Central Institutes/Universities,” the MCC said.

During the two consecutive day hearing which started on Wednesday, the Centre had told the apex court that the introduction of OBC and EWS reservations after the issuance of NEET-PG exam notification does not amount to "changing the rules of the game" midway. Solicitor General Tushar Mehta, appearing for the Centre, had submitted that the submission of petitioners that OBC reservation is unconstitutional is legally unsustainable.
The last notice released by the Medical Counselling Committee (MCC) was for candidates who want to convert their nationality from Indian to NRI. This year the NEET UG, PG Counselling will be different as the MCC will be conducting four rounds of counselling for All India Quota (AIQ) seats. The vacant seats will not go back to the state quota after the second round of counselling, the MCC notice read.
The official website of the Medical Counselling Committee (MCC) still says "NEET PG Counselling 2021 has been postponed till further orders". However, the MCC is soon expected to announce the NEET PG 2021 Counselling schedule and NEET UG Counselling dates. The Supreme Court allowed the resumption of counselling for NEET-PG 2021 as per the existing reservation policy, including 27% for OBC and 10% for EWS.
The Federation of Resident Doctors’ Association (FORDA), which had organised protests and strikes in December against the delays in NEET PG counselling 2021 said that it welcomes the judgment of the Supreme Court of India.

After the Supreme Court judgment, FAIMA doctors association urged the government to release NEET UG, PG Counselling schedule immediately. "Counselling cannot be delayed further as we may be reaching the peak in less than a month, and shall require adequate manpower to handle a huge number of cases in the country," FAIMA doctors association said.

The Kerala High Court today dismissed a plea moved by MBBS graduates challenging a circular issued by the State government increasing reservation for the socially and economically backward classes (SEBC) from 9% to 27% in medical postgraduate courses, as per the Live Law report.

The Supreme Court, in an interim order, allowed resumption of medical counselling for NEET-PG admissions for the year 2021-22, and upheld the validity of 27% OBC and 10% EWS quotas. A bench of justices DY Chandrachud and AS Bopanna said that the counselling for the NEET-PG for the academic year 2021-22 will proceed as per the criteria already notified.

UG, PG NEET News: With the Supreme Court allowing NEET UG, PG counselling to start for 2021, the process can start. However, it will be different this year with four rounds of AIQ counselling instead of two and seats vacant after round 2 will not go back to the state quota.

Justice DY Chandrachud says, "The validity of the criteria determined by the Pandey committee for identifying the EWS prospectively for the future be subject to the final results of the petition. The petition shall be listed for final hearing on the validity of the EWS criteria as recommended by the Pandey committee in the third week of March 2022."
Once the SC decision on NEET was announced, those watching the developments wanted to know the "upheld meaning in law". It means the SC has accepted and allowed an existing policy or decision, in this case the 27% OBC quota in the AIQ of medical seats. It has upheld the constitutional validity of this part of the reservation policy. However, on the 10% EWS quota judgment is still out.
The Court passed an interim order with the following directions, as per Live Law:
1. We accept the recommendations of the Pandey committee that the criteria which have been stipulated in OM 2019(for EWS) be used for 2021–20 22 in order to ensure that the admission process is not dislocated
2. Counselling on the basis of NEET PG 2021 and Neet UG 2021 shall be conducted by giving effect to the resolution as provided by the notice dated 29 July 2021 including the 27% reservation for OBC category and 10% reservation for EWS category in the all India quota seats.

While the Supreme Court has settled the matter on the 27% OBC quota in NEET UG counselling 2021 and NEET PG counselling 2021, it will continue to hear the case on the 10% EWS quota. That verdict is due in the third week of March, 2022. However, it will not impact admission to MBBS, BDS, MD, MS and others for the 2021 round.
The bench has now listed the petition for final hearing to determine the validity of EWS criteria as determined by the Pandey Committee in the 3rd week of March.

Senior Advocate Arvind Datar yesterday urged Supreme Court to keep EWS criteria in NEET PG Counselling at 2.5 lakhs in the alternative.
During yesterday's Supreme Court hearing on NEET PG Counselling, Senior Advocate P Wilson points out that the July 29 notification on OBC came following a direction from the Madras High Court. “ We have filed judgement of Mad HC which held that when Central Govt Educational Institutions are concerned, there would be no harm in states granting reservation to too,” he said, as per Live Law report.
Tamil Nadu Chief Minister M K Stalin on Thursday announced an all-party meeting on January 8 here to discuss the next course of action on the state's demand for exemption from NEET, as an Assembly bill in this regard is pending with the Centre. Recalling the unanimous Assembly bill passed in September against NEET, Stalin said, "Our struggle against NEET and for social justice will continue." He reiterated NEET was against the interests of the rural students and charged the Centre, through the entrance test had "snatched away" states' rights to decide on how it will conduct its medical admissions, with the state keen to do so only based on Class 12 marks.

Delays in NEET PG and counselling meant a year of no admission for postgraduation. In July, the union government notified new quotas in postgraduate and undergraduate seats for the Other Backward Classes (27%) and Economically Weaker Sections (10%). These reservations were to be implemented in the seats “surrendered” to the central pool by state-run medical colleges. This pool, the “all-India quota”, claims 15% MBBS seats and 50% postgraduate seats in state colleges.

NEET PG Supreme Court judgement today. Earlier, resident doctors, who were protesting to expedite NEET PG Counselling 2021, called off the agitation and said that the health minister agreed to the following demands in the meeting held on December 29.

The NEET UG 2021 counselling process has begun for the state seats in many states including Maharashtra. However, the process for the 15% all-India quota (AIQ) seats and with that, admission to all central institutions, is held up by the Supreme Court case for which the order is coming today.

Following this, The MCC had postponed the NEET PG 2021 counselling registration, which was scheduled to begin on October 25 at mcc.nic.in due to a pending court case on EWS, OBC reservation. The Supreme Court hearing on the reservation policy in medical seats was deferred multiple times and was taken up on January 5 after the Centre requested to hear the matter citing "some urgency".
The National Medical Commission (NMC) has directed the government medical colleges to compulsorily keep 15% MBBS seats and 50% postgraduate MD/ MS seats in the All India Quota.
