SC dismisses plea against cancellation of CBSE, ICSE 12th exams 2021

NEW DELHI: The Supreme Court today dismissed the plea against the cancellation of CBSE, ICSE 12th exams 2021. As per the Live Law report, "The court also upheld the schemes formulated by the boards. And, students will be given the option to give exams if they are not satisfied with the marks awarded." Check updates here.

A vacation bench comprising Justices AM Khanwilkar and Dinesh Maheshwari dismissed all petitions, which challenged the cancellation of board exams observing that the decision was taken at the "highest level" to protect the welfare of over 20 lakh students, the report said.

The court said that “there should be a finality to the status of exams as uncertainty was affecting the psychology of students”.

As per Live Law Tweet, “Present scheme provides that exams will be duly conducted in which all these students can appear as private candidates, and that exam will be by 15th August- 15th Sept and results will be declared at earliest. The scheme deals with this eventuality.”

The Court will not interfere with the decision taken by the CBSE and ICSE board to cancel the physical examination of Class 12.

“The fact that other boards or institutions have been able to conduct exams, does not mean that the boards before us are bound by those decisions. These Boards are independent Boards. They have taken the decision to cancel exams which according to them is in the larger public interest of the students', the bench observed the order,” report added.
