NEW DELHI: The Supreme Court has dismissed the plea against the cancellation of 12th board exams. The apex court said that the evaluation criteria to assess the students is "fair and reasonable and there is no reason to interfere with the CBSE and CISCE schemes.

A vacation bench of Justices AM Khanwilkar and Dinesh Maheshwari heard the response of CBSE and ICSE. The 12th board examinations were cancelled due to the COVID-19 situation in the country.
Earlier, Senior Lawyer Vikas Singh said, “Even a senior Mathematics teacher couldn’t understand the CISCE’s evaluation scheme completely then how can students understand it?”
In response to that Justice Khanwilkar said, "We cannot go by individual's view. If the scheme is discriminatory, we can understand but cannot go by an individual,” the report added.
The Supreme Court has asked both boards to clarify the petitioner's complaints. Meanwhile, the court will also hear the petition filed by Class 12 private and compartment students against the board’s decision on holding physical examinations amid the prevailing COVID-19 pandemic.
The board has earlier announced conducting optional CBSE board exams tentatively from August 15 to September 15, 2021, depending on the COVID-19 situation.

"Objection was made for compartment, private and Patrachar students. Analogy of proposed scheme cannot be applied to private , compartment or patrachar students." the Bench observed.
The Bench added, "All aspects were taken into account and decision regarding formulation of the scheme was taken with a holistic approach to ensure no candidate is prejudiced. It’s not possible to approach second guess approach as suggested by Mr Singh."

The bench dsaid, "We observe its not possible to accept suggestions made by MR singh. At the outset Mr Gupta appearing in person stated that it would be appropriate to direct Boards to conduct examination. It’s not possible to execute the suggestion.

AG said, "Exams will start on 15th exams and considering there’s are many subjects it will be done by 15 September."
AG said to Supreme Court: "This situation has arisen for first time. They had to innovate and think of students’ best interest. 13 experts have put their heads together and has been approved by Board by 30 members," as per Live Law.

Any candidate will straight way not know where he/she is going to stand. What’s been provided is they are preparing results on this basis, and who isn’t satisfied may take exams, said Justice Maheshwari
Senior Lawyer Vikas Singh said, "There should be only one result. I don’t want improvisation etc. That will create uncertainty for students."
If a student says they do want internal assessment, and exams are taken if situation is better, they can’t go back to internal marks. In second situation, if they only take internal assessment, chance of improving won’t be there.
The bench further added, "What we’re saying is at outset you take confirmation from the students. Those who opt for writing exams don’t opt for internal assessment. Thats their conscious decision."
Had it been a competitive exams, your argument may have been relevant. These are qualifying exams, one person’s marks won’t affect you. It would be better for students to take an improvement exam.
AG also said, "Suppose he takes option of not taking, In those circumstances he will have right to see internal assessment, if his marks are good he won’t have to take exams, as results of exams are final."

Sr Adv Vikas Singh for intervenors said, " I’m representing at least thousands. The petitioner here is not representing anyone. We are saying option should be given to schools as well."

Justice Maheshwari said, "Individual perception will not decide this matter. A larger decision needs to be taken which was taken last year also. Government has already taken a decision and thereafter we endorsed it," reported by Live Law.
As per the Live Law tweet, the bench said, "Each board is different. Logistical arrangements are to be provided. Board is conscious of this. Decision has been taken by highest authorities & is a well informed decision."

As per Live Law report, Supreme Court will hear the ICSE and CBSE physical examination cancellation and evaluation scheme matter at 2:35 pm today.
A division bench of justice AM Khanwilkar and Justice Dinesh Maheshwari will hear ICSE and CBSE Class 12 board exam 2021 result criteria shortly.
Supreme Court is expected to take a final call today on the proposed aspects such as redressal mechanism of ICSE and CBSE 12th evaluation criteria, date of optional exam etc. Earlier, CBSE Class 12 evaluation criteria 2021 of 30:30:40 formula was accepted by the Supreme Court of India on June 17, 2021.
The adjourned hearing of the Supreme Court on pleas challenging the decision of the Central Board of Secondary Education (CBSE) and the Council for the Indian School Certificate Examinations (CISCE) on Class 12 evaluation criteria 2021 is expected to start soon.

The Supreme Court will hear the petition filed by Class 12 private and compartment students against the board’s decision on holding physical examinations amid the prevailing COVID-19. The Court is expected to take some decision on evaluation criteria for class 12 CBSE and ICSE.

The Supreme Court on Monday adjourned the CBSE and ICSE evaluation criteria hearing. The Court will hear the matter today at 2 pm. The vacation bench of Supreme Court will hear the petitioners before suggesting any changes in it.
