NEET PG 2025 candidate from Punjab moves court after missing Maharashtra seat

A NEET PG 2025 candidate from Punjab has filed a writ petition in the Bombay High Court against the National Eligibility Entrance Test (NEET PG) counselling rules in Maharashtra barring him from applying for PG seat in private unaided colleges under any quota for completing MBBS outside the state.

The student named Gursimrat Singh Chhabra, belonging to the general category, was born and brought up in Punjab and studied MBBS from All India Institute of Medical Sciences (AIIMS) Rishikesh in Uttarakhand. He cleared NEET PG 2025 and became eligible for PG medical courses as per merit norms.

In his petition, he argued that several colleges informed him that he was ineligible for both the 15% Non-Resident Indian (NRI) quota and the 35% institutional quota because he did not complete his graduation from Maharashtra. He was told that only two categories of students from outside the state are eligible for institutional seats: those who pursued MBBS outside Maharashtra under the 15% All India Quota (AIQ), and those who are domicile of Maharashtra.

Since the petitioner is neither a state domicile nor an AIQ candidate, he has been rendered ineligible for all PG seats in private unaided institutions in the state, as per the Maharashtra NEET PG counselling rules.

Maharashtra NEET PG counselling rules

The NEET PG aspirant has challenged the constitutional validity of Rule 5 (1) and Rule 7(3) framed under Maharashtra Unaided Private Professional Educational Institutions (Regulations Of Admissions And Fees ) Act 2015 and Rule 8.2 of the Information Brochure of the State of Maharashtra.

He has sought a direction from the HC to declare him eligible for the 50% institutional quota, including the 15% NRI quota, in PG medical seats in Maharashtra’s private medical colleges.
